Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:
Cooling-off period: the period during which the consumer may exercise the right of withdrawal;
Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance agreement with the entrepreneur;
Day: calendar day;
Continuous transaction: a distance agreement relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;
Right of withdrawal: the possibility for the consumer to withdraw from the distance agreement within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance agreement: an agreement concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more remote communication techniques up to and including the conclusion of the agreement;
Remote communication technique: a means that can be used to conclude an agreement without the consumer and the entrepreneur being simultaneously present in the same place;
Terms and Conditions: the present Terms and Conditions of the entrepreneur.

Article 3 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.

Before a distance agreement is concluded, the text of these Terms and Conditions shall be made available to the consumer. If this is not reasonably possible, it shall be indicated before the agreement is concluded that the Terms and Conditions can be inspected at the entrepreneur’s premises and will be sent free of charge upon request.

If the agreement is concluded electronically, the Terms and Conditions may be made available electronically in such a way that they can easily be stored on a durable data carrier. If this is not reasonably possible, it shall be indicated where the Terms and Conditions can be consulted electronically and that they will be sent free of charge upon request.

If specific product or service conditions apply in addition to these Terms and Conditions, the consumer may always rely on the provision that is most favourable to them in the event of conflicting conditions.

If one or more provisions in these Terms and Conditions are wholly or partially void or annulled, the remaining provisions shall remain in force, and the invalid provision shall be replaced by a provision that most closely reflects the intent of the original provision.

Situations not regulated in these Terms and Conditions shall be assessed in the spirit of these Terms and Conditions.
Any ambiguities regarding interpretation shall also be interpreted in the spirit of these Terms and Conditions.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this shall be explicitly stated.

All offers are without obligation. The entrepreneur reserves the right to amend or withdraw the offer.

The offer contains a complete and accurate description of the products and/or services. Images are a truthful representation. Obvious errors do not bind the entrepreneur.

All images, specifications, and details are indicative and cannot give rise to compensation or dissolution of the agreement. Displayed colours may differ from actual colours.

Each offer contains sufficient information regarding price (excluding import VAT and customs clearance costs), shipping costs, conclusion method, applicability of withdrawal rights, payment and delivery methods, acceptance period, communication costs, data correction options, available languages, applicable codes of conduct, and minimum contract duration where applicable.

Optional information may include available sizes, colours, and materials.


Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and meets the stated conditions.

Electronic acceptance is confirmed electronically. Until confirmation, the consumer may dissolve the agreement.

The entrepreneur takes appropriate security measures for electronic transactions and payments.

The entrepreneur may refuse or impose conditions on an order if there are justified reasons based on payment ability.

Consumers receive written information regarding complaints, withdrawal rights, warranties, contract details, and termination conditions.

Continuous transactions apply only to the first delivery.

All agreements are concluded subject to sufficient product availability.


Article 6 – Right of Withdrawal

The consumer may withdraw from the agreement within fourteen days without stating reasons, starting the day after receipt of the product.

Products must be handled carefully and only used to assess suitability.

The consumer must notify withdrawal in writing or by email within fourteen days and return the product within fourteen days, providing proof of shipment.

Failure to meet these obligations makes the purchase final.


Article 7 – Costs in Case of Withdrawal

Return shipping costs are borne by the consumer.

Refunds will be processed within fourteen days after withdrawal, provided the returned goods are received or proof of return is supplied.


Article 8 – Exclusion of the Right of Withdrawal

Withdrawal may be excluded for custom-made products, personal items, perishable goods, market-linked products, newspapers and magazines, unsealed audio/video/software, and unsealed hygienic products.

For services, exclusion applies to accommodation, transport, leisure services on specific dates, services started with consent, and betting and lottery services.


Article 9 – Prices

Prices remain unchanged during the offer validity period except for VAT rate changes.

Market-dependent products may have variable pricing.

Delivery takes place outside the EU. Import VAT and clearance fees are collected by postal or courier services. No VAT is charged by the entrepreneur.

Prices are subject to typographical errors.


Article 10 – Conformity and Warranty

Products and services comply with agreement specifications and legal standards.

Warranty does not affect statutory consumer rights.

Defects must be reported within fourteen days and returned unused and in original packaging.

Warranty excludes misuse, unauthorized repairs, abnormal conditions, and government-imposed material requirements.


Article 11 – Delivery and Execution

Orders are executed with due care and delivered to the provided address within thirty days unless otherwise agreed.

In case of delay or incomplete delivery, the consumer may dissolve the agreement without cost.

Risk transfers upon delivery.


Article 12 – Continuous Transactions: Duration, Termination, and Renewal

Indefinite agreements may be terminated with one month’s notice.

Fixed-term agreements may be terminated at the end of the term.

Automatic renewal is limited by law.

Contracts exceeding one year may be terminated after one year with one month’s notice.


Article 13 – Payment

Payments must be made within seven working days after the cooling-off period begins.

Incorrect payment details must be reported immediately.

Reasonable collection costs may be charged in the event of non-payment.


Article 14 – Complaints Procedure

Complaints must be submitted within seven days after detection.

Complaints are answered within fourteen days.

Valid complaints may result in repair or replacement.


Article 15 – Disputes

All agreements governed by these Terms and Conditions are subject exclusively to Canadian law, even if the consumer resides abroad.
